1. Acceptance of Terms

to JustPrint. This portal provides its services to you, subject to
the following Terms of Service (‘TOS’), which may be updated from time to time without
any notice to you. You can review the most current version of the ‘TOS’ at any time
from our website
www.JustPrint.in . In addition, with this service, you shall be subject
to any posted guidelines or rules applicable to such services which may be posted
by us from time to time.
2. Description of Service
2.1 JustPrint currently provides you with the service which
includes printing and packing of documents built by you within JustPrint
website using features in the website comprising of files in PDF form, either directly
uploaded through JustPrint website or through JustPrint
virtual printer driver, and the delivery of the same to the courier destinations
within JustPrint courier network. You also understand and agree that the Service
may include advertisements pertaining to JustPrint or its own other
services or businesses or associate companies. You also understand and agree that
the service may include certain communications from JustPrint, such
as service announcements, administrative messages and that these communications
are considered part of JustPrint membership and you will not be able
to opt out of receiving them. Unless explicitly stated otherwise, any new features
that augment or enhance the current Service, shall be subject to the ‘TOS’. You
understand and agree that the Service is provided "AS-IS" and that JustPrint
assumes no responsibility for the timeliness, deletion, mis-delivery or failure
to store any user communications or personalization settings.
2.2 You are responsible for obtaining access to the Service and that access
may involve third party fees (such as Internet service provider or airtime charges).
You are responsible for those fees. In addition, you must provide and are responsible
for all equipment necessary to access the Service.
2.3 JustPrint service features and rates will be as per the specifications
in the section titled ‘Pricing’ given in this website, which may be revised
from time to time without any notice to you.
3. Your Registration Obligations
In
consideration of your use of the Service, you agree to: (a) provide true, accurate,
current and complete information about yourself as prompted by the Service's registration
form (such information being the "Registration Data") and (b) maintain and promptly
update the Registration Data to keep it true, accurate, current and complete always.
The Service can be accessed and you can register yourself at the JustPrint
website only if you are 18 years of age or above. If JustPrint has
reasonable grounds to suspect that any such information provided by you is untrue,
inaccurate, not current or incomplete, JustPrint has the right to
suspend or terminate your account and refuse any and all current or future use of
the Service (or any portion thereof).
4. Member Account, Password and Security
You
will be prompted to enter a password while completing the registration process.
You are responsible for maintaining the confidentiality of the password and account,
and are fully responsible for all activities that occur under your password or account.
You agree to (a) immediately notify JustPrint of any unauthorized
use of your password or account or any other breach of security, and (b) ensure
that you exit from your account at the end of each session. JustPrint
cannot and will not be liable for any loss or damage arising from your failure to
comply with this Section.
5. Member Conduct
You
agree to conform to the laws prevailing in India and internationally. You agree
to not use the Service to (a). upload, email, transmit or otherwise make available
any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous,
defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or
racially, ethnically or otherwise objectionable (b) harm minors in any way (c} impersonate
any person or entity, including, but not limited to, JustPrint officials
or representatives or falsely state or otherwise misrepresent your affiliation with
a person or entity (d) forge headers or otherwise manipulate identifiers in order
to disguise the origin of any Content transmitted through the Service (e) upload,
email, transmit or otherwise make available any Content that you do not have a right
to make available under any law or under contractual or fiduciary relationships
(such as inside information, proprietary and confidential information learned or
disclosed as part of employment relationships or under nondisclosure agreements)
(f) upload, email, transmit or otherwise make available any Content that infringes
any patent, trademark, trade secret, copyright or other proprietary rights ("Rights")
of any party (g) upload, email, transmit or otherwise make available any unsolicited
or unauthorized advertising, promotional materials, "junk mail", "spam", "chain
letters", "pyramid schemes" or any other form of solicitation (h) upload, email,
transmit or otherwise make available any material that contains software viruses
or any other computer code, files or programs designed to interrupt, destroy or
limit the functionality of any computer software or hardware or telecommunications
equipment (i) interfere with or disrupt the Service or servers or networks connected
to the Service, or disobey any requirements, procedures, policies or regulations
of networks connected to the Service (j). "stalk" or otherwise harass another or
(k) collect or store personal data about other users.
You
acknowledge that JustPrint does not pre-screen Content, but that
JustPrint and its designees shall have the right (but not the obligation),
in their sole discretion, to refuse or move any Content that is available via the
Service. Without limiting the foregoing, JustPrint and its designees
shall have the right to remove any Content that violates the ‘TOS’ or is otherwise
objectionable. You agree that you must evaluate, and bear all risks associated with
the use of any Content, including any reliance on the accuracy, completeness, or
usefulness of such Content.
You acknowledge and agree that JustPrint may preserve Content and
may also disclose Content if required to do so by law or in the good faith and belief
that such preservation or disclosure is reasonably necessary to (a) comply with
legal process (b) enforce the ‘TOS’ (c) respond to claims that any Content violates
the rights of third-parties or (d) protect the rights, property, or personal safety
of JustPrint, its users and the public. You understand that the technical
processing and transmission of the Service, including your Content, may involve
(a) transmissions over various networks and (b) changes to conform and adapt to
technical requirements of connecting networks or devices.
6. Special Admonitions for International Use
Recognizing the global nature of the
Internet, you agree to comply with all local rules regarding online conduct and
acceptable Content. Specifically, you agree to comply with all applicable laws regarding
the transmission of technical data exported from the country in which you reside
or the mail originates.
7. Indemnity
You
agree to indemnify and hold JustPrint and its subsidiaries, affiliates,
officers, agents, co-branders or other partners, and employees, harmless from any
claim or demand, including attorneys' fees incurred by JustPrint and
any third party etc due to or arising out of Content you submit, post, transmit
or make available through the Service, your use of the Service, your connection
to the Service, your violation of the ‘TOS’, or your violation of any rights of
another and also any violation of laws of the land.
8. No Resale of Service
You
agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial
purposes, any portion of the Service, use of the Service, or access to the Service.
9. Print Quality
The
print quality of the documents printed by JustPrint would be 600 'dpi'
(generally, and mostly) or less depending upon the resolution of the file(s) uploaded
by the customers. To illustrate the point further, in case the resolution of an
uploaded file is 300 'dpi', then in that case the resolution of such documents printed
by JustPrint would be 300 'dpi' only. On the other hand, if an uploaded
file carries a resolution of 2400 'dpi', the print quality of documents provided
by JustPrint would be 600 'dpi' only. In other words, the print quality
provided by JustPrint would be either 600 'dpi' or less, as the case
may be. JustPrint cannot and will not be liable for any loss or damage
arising out of documents printed and provided by it which will essentially be done
on an 'As-is' basis. Furthermore, you acknowledge and agree that in all these respects,
JustPrint decision shall be final and binding.
10. General Practices Regarding Use and Storage
You
acknowledge that JustPrint may establish general practices and limits
concerning use of the Service, including without limitation the maximum number of
days that the uploaded Print Files and created Documents, History of Orders or any
other stored information will be retained by the Service, the maximum number of
Print Files that may be uploaded or the maximum number of Documents that may be
created by an account on the Service, the maximum size of any file that may be uploaded
from an account on the Service, the maximum disk space that will be allotted on
JustPrint servers on your behalf, and the maximum number of times
(and the maximum duration for which) you may access the Service in a given period
of time. You agree that JustPrint has no responsibility or liability
for the deletion or failure to store any file uploaded or created or other Content
maintained or transmitted by the Service. You acknowledge that JustPrint
reserves the right to log off accounts that are inactive for an extended period
of time. You further acknowledge that JustPrint reserves the right
to change these general practices and limits at any time, at its sole discretion,
with or without notice.
11. Modifications to Service
JustPrint reserves the right at any time and from time to time to modify
or discontinue, temporarily or permanently, the Service (or any part thereof) with
or without notice. You agree that JustPrint shall not be liable to
you or to any third party for any modification, suspension or discontinuance of
the Service.
12. Termination
You
agree that JustPrint may, under certain circumstances and without
prior notice, immediately terminate your JustPrint account and access
to the Service. Cause for such termination shall include, but not be limited to
(a) breaches or violations of the ‘TOS’ or other incorporated agreements or guidelines
(b) requests by law enforcement or other government agencies (c) a request by you
(self-initiated account deletions) (d) discontinuance or material modification to
the Service (or any part thereof) (e) unexpected technical issues or problems and
(f) extended periods of inactivity. Termination of your JustPrint
account includes (a) removal of access to all offerings within the Service (b) deletion
of your password and all related information, files and content associated with
or inside your account (or any part thereof) and (c) barring further use of the
Service. Further, you agree for that all terminations, the cause shall be made at
JustPrint's sole discretion and that JustPrint shall
not be liable to you or any third party for any termination of your account, any
associated email address, or access to the Service.
13. Dealings with Advertisers
Your
correspondence or business dealings with, or participation in promotions of, advertisers
found on or through the Service, including payment and delivery of related goods
or services, and any other terms, conditions, warranties or representations associated
with such dealings, are solely between you and such advertiser. You agree that
JustPrint shall not be responsible or liable for any loss or damage
of any sort incurred as the result of any such dealings or as the result of the
presence of such advertisers on the Service.
14. JustPrint’s Proprietary Rights
You
acknowledge and agree that the Service and any necessary software used in connection
with the Service ("Software") contain proprietary and confidential information that
is protected by applicable intellectual property and other such laws. You further
acknowledge and agree that Content contained in sponsor advertisements or information
presented to you through the Service or advertisers is protected by copyrights,
trademarks, service marks, patents or other proprietary rights and laws. JustPrint
grants you a personal, non-transferable and non-exclusive right and license to use
the object code of its Software on a single computer; provided that you do not (and
do not allow any third party to) copy, modify, create a derivative work of, reverse
engineer, reverse assemble or otherwise attempt to discover any source code, sell,
assign, sub-license, grant a security interest in or otherwise transfer any right
in the Software. You agree not to modify the Software in any manner or form, or
to use modified versions of the Software, including (without limitation) for the
purpose of obtaining unauthorized access to the Service. You agree not to access
the Service by any means other than through the interface that is provided by
JustPrint for use in accessing the Service.
15. Disclaimer of Warranties
You
expressly understand and agree that:
a)
Your use of the service is at your sole risk. The Service is provided on an
"AS IS" and "AS AVAILABLE" basis. JustPrint
expressly disclaims all warranties of any kind, whether expressed or implied, including,
but not limited to the implied warranties of merchantability, fitness for a particular
purpose and non-infringement.

JustPrint makes no warranty that (i) the Service will meet your requirements
(ii) the Service will be uninterrupted, timely, secure, or error free (iii) the
results that may be obtained from the use of the Service will be accurate or reliable
(iv) the quality of any product, Services, information, or other material obtained
by you through the Service will meet your expectations (v) the quality and any other
standards of any material received by you at any time as a product or as part of
a product will be maintained or will be exactly the same in subsequent deliveries
to you and (vi) any errors in the software will be corrected.
c)
Any material downloaded or otherwise obtained through the use of the Service is
done at your own discretion and risk and that you will be solely responsible for
any damage to your computer system or loss of data that results from the download
of any such material.
d)
No advice or information, whether oral or written, obtained by you from JustPrint
or through or from the Service shall create any warranty not expressly stated in
the ‘TOS’.

e) JustPrint shall not be responsible for the files uploaded in a
garbled, distorted, mutilated manner or the files uploaded being partly or wholly
lost or suffers hackings or any other intervention which may affect the fulfillment
of the Service.
16. Limitation of Liability
(a)
You expressly understand and agree that JustPrint shall not be liable
for any direct, indirect, incidental, special, consequential or exemplary damages,
including but not limited to, damages for loss of profits, goodwill, use, data or
other intangible losses, resulting from (i) the use or the inability to use the
Service (ii) the cost of procurement of subsequent goods and services resulting
from any goods, data, information or services purchased or obtained or materials
received or transactions entered into, through or from the Service (iii) unauthorized
access to or alteration of your transmissions or data (iv) statements or conduct
of any third party on the service; or (v) any other matter relating to the Service.
(b)
JustPrint shall not incur any liability by reason of the loss, mis-delivery
or delay of or damage to files or documents except in so far as such liability may
in express terms be undertaken by JustPrint as provided and no official
of JustPrint shall incur any liability by reason of any such loss,
mis-delivery, delay or damage unless he has caused the same fraudulently or by his
willful act.
17. Notice
Notices
to you may be made via email. The Service may also provide notices of changes to
‘TOS’ or other matters by displaying notices
or links to notices to you generally on the Service.
18. Trademark Information
JustPrint, the JustPrint logo, logos and product and service
names are trademarks of JustPrint. Without JustPrint’s
prior permission, you agree not to display or use in any manner, the JustPrint
trademarks.
19. Cancellation and Refunds
a. Cancellation
<Since
you go through a fairly long and elaborate process of placing your order(s) which
will finally culminate in you making the payment through a Credit Card, which again
is fairly lengthy, it is assumed by JustPrint.in that all the Orders that
have been received have been placed by the customer(s) carefully. There is no such
option as ‘Cancellation of an Order’ in the JustPrint.in website.
All
orders received will be printed as per specifications defined by the customer(s)
and will be shipped to the desired destination(s) at the earliest possible. The
sole reason for JustPrint.in for not providing the option of cancelling the
orders to its customers is that the process of printing the uploaded files is seamless
and the moment an order is received by the JustPrint server, all the
uploaded files get lined-up for printing, without any interregnum or loss of time.
b. Refunds
Since
there is no such customer accessible option as ‘Cancellation of an Order’ in the
JustPrint.in website, no refunds of any sort would be made against any order.
However,
in case of any instance of wrongly made multiple payments is found against any order,
the excess debited amount will be credited back to the customers credit card as
per the rules and regulations of JustPrint.in and concerned third parties including
the Payment Gateway service provider bank and the corresponding duplicated orders,
if any such cases occurred, will be treated as cancelled, after consultation through
appropriate media and consent from the customer.
20. Discount Schemes etc.
JustPrint may, at its sole discretion, from time-to-time, launch Discount
Schemes or any other schemes, for its valued customers. It would be JustPrint’s
exclusive prerogative to launch, execute, implement and withdraw all such schemes,
with or without any notice to you. All decisions taken by JustPrint,
with respect to the launch, implementation, execution or withdrawal of any or all
such schemes, will be final and binding.
21. Delivery Policy
a. Shipping
You
understand, agree and accept that:

JustPrint utilizes the courier network run by one of its group companies,
Overnite Express Limited, for the shipping of customer orders.

JustPrint assumes no responsibility for the delay or failure of delivery
of the consignments and for storing any such consignments for future delivery.

The
quality and any other standards of any material or its packing received by you at
any time as a product or as part of a product may not be maintained or may not be
exactly the same in subsequent deliveries to you
-
JustPrint shall not incur any liability by reason of the loss, mis-delivery
or delay of or damage to files or documents except in so far as such liability may
in express terms be undertaken by JustPrint as provided and no official
of JustPrint shall incur any liability by reason of any such loss,
mis-delivery, delay or damage unless he has caused the same fraudulently or by his
willful act.
b. Incorrect Address
JustPrint assumes no responsibility, if it is not possible to deliver
a shipment because of an incorrect address. To exercise appropriate and reasonable
efforts to find the correct address will be at the sole discretion of the shipment
carrier as per their rules and regulations.
c. Undeliverable and Rejected shipments
JustPrint
never keep any kind of undelivered consignment and assumes no responsibilities on
such items.
d. Exclusions
JustPrint is not liable for any consequential or special damages or loss
(including loss of income, profits, markets reputation, use of contents or loss
of an opportunity) or other indirect loss arising from the loss, damage, delay,
mis-delivery or non-delivery of your shipment even if we had knowledge that such
damages or loss might arise.
JustPrint is not liable if your shipment or any part of it is lost, damaged,
delayed or misdelivered or not delivered at all as a result of:

Circumstances
beyond our control such as (but not limited to):
-
acts
of God including earthquakes, cyclones, storms, flooding, fire, disease, fog, snow
or frost.
-
force
majeure including war, accidents, act of public enemies, strikes, embargoes, perils
of the air, local disputes, or civil commotions.
-
national
or local disruptions in air or ground transportation networks, mechanical problems
to the modes of transport or machinery.
-
latent
defects or inherent vice in the contents of the shipment.
-
The
contents of the documents consisting of any article that is a prohibited item even
though we may have accepted the order and shipped it by mistake.
e. Claims
If
you wish to claim for a lost, damaged or delayed shipment you must comply with the
following procedure otherwise we reserve the right to reject your claim.

We
will assume the shipment was delivered in good condition unless the receiver has
noted any damage on our delivery record when he or she accepted the shipment.
-
If
you wish to claim for a lost, damaged or delayed shipment, in order for us to consider
the claim, the contents of your shipment and the original packaging must be made
available to us for inspection.
22. Legal Terms
The
final right of refusing any kind of printing or shipping of your order lies with
JustPrint.in; for any purpose violative of any law of land, prevailing directly
or indirectly related to the use of Services; failing which JustPrint
will be left with no option but to take all steps available to them as per law including
initiation of appropriate Civil and Criminal proceedings against you. However, the
agreement and all the disputes and claims relating in anyway to, or arising out,
shall be governed by THE COURTS HAVING JURISDICTION OF DELHI.
